Government Authority located in High Point, North Carolina; USA based organization looking for expert vendor for legal services.
[A] Budget: Looking for Proposals
[B] Scope of Service:
(1) Vendor needs to provide legal services to the government authority located in High Point, NC.
- State and local law and legislative issues (public records act, open meetings law, local government finance act, housing authority law) and related matters;
- Real estate, land use, planning, zoning, private partnerships, complex financing, environmental, development, redevelopment and revitalization issues, demolition and disposition of public housing, and other related matters;
3. Federal government law and legislative issues (HUD and executive branch rules and regulations, and federal legislation), and related matters;
4. Public financing, tax exempt and taxable multi-family housing revenue bonds, low income housing tax credit matters and related matters;
5. Landlord and tenant and property management issues particularly with respect to public housing and compliance with state law and applicable federal regulations;
6. Taxation issues (federal, state, and local) relating to real property, non-profit corporations, public corporations, real estate development partnerships, and related matters;
7. Legal counsel to HPHA including attendance at monthly board of commissioner’s meetings and other special meetings as requested;
8. Provide written legal opinions with respect to HPHA policies, procedures and transactions;
9. Contracting (construction, architectural and engineering, professional, general services, supplies, etc.) and procurement issues (HUD regulatory advice, solicitation procedures, bid protests, procurement contract development and review) and any related matters;
10. Labor and employment law, EEOC, FMLA, workers compensation, employee benefits, Americans with disabilities act issues, and related matters;
11. General business issues (debtor-creditor, corporate formation, partnerships, other commercial transactions);
12. Leases and agreements for the use of HPHA facilities;
13. Memorandum of agreement and understanding or contracts between agencies related to services and programs for program participants of HPHA;
14. Tort issues (insurance coverage, negligence, malpractice, defamation, intentional and unintentional acts causing injury to persons or property) and related matters;
15. General litigation relating to the areas listed above, including representation in trials, administrative hearings, mediations, arbitrations, federal, state and local proceedings. HPHA and the state licensed attorney-at-laws or law firms, agree that the HUD Handbook No. 1530.1, REV-5, dated May 18, 2004, and all amendments thereto are hereby incorporated into this contract as if fully set forth herein;
16. Work with private property management and real estate activities;
17. Assist with HUD mixed finance transaction matters.
18. Protect and preserve the legal rights of the HPHA;
19. Review, draft and offer legal opinion on contracts and leases;
20. Provide legal assessments and recommendations; conduct factual and legal analysis to determine whether legal issues should be negotiated or prosecuted, based on the facts of law and evidence;
21. Conduct legal research; gather and compile legal instruments and documents; identify and evaluate records and other information; and prepare and present legal documents, analyses, and policy revisions as required;
22. Monitor trends in public housing law, regulations and risk management matters;
23. Assure absolute confidentiality of work-related issues, client records and HPHA information;
24. Be knowledgeable of HPHA's organization, operations, and policies;
25. Have knowledge of legal precedents and court decisions impacting public housing
26. Advise the CEO or designee of legal issues relating to personnel matters;
27. Be licensed to practice law in the state;
28. Attend and provide guidance during any or all HPHA, and its affiliates, board meetings (regular and special) and any other meeting as requested;
(2) All questions must be submitted no later than June 17, 2019.
(3) Contract term will be one year.
